These Terms and Conditions set out the basis on which Rubbish Collection Belgravia provides waste and rubbish collection services to domestic and commercial customers. By making a booking, using our services, or allowing our operatives to access your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order for services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the individual, business, company, or organisation that requests or receives services from Rubbish Collection Belgravia.

Services means any rubbish removal, waste collection, house or office clearance, bulky waste uplift, garden waste removal, or related services provided by Rubbish Collection Belgravia.

Waste means any items, materials, or rubbish presented by the Customer for collection, removal, or disposal as part of the Services.

Operative means any employee, contractor, or representative engaged by Rubbish Collection Belgravia to deliver the Services.

Contract means the agreement between the Customer and Rubbish Collection Belgravia for the provision of Services, as governed by these Terms and Conditions.

2. Scope of Services

Rubbish Collection Belgravia provides rubbish and waste collection services within its designated service area, subject to availability and operational constraints. Services may include scheduled collections, one-off clearances, and ad hoc removal of household or commercial waste, as agreed at the time of booking.

We reserve the right to refuse to collect certain items where they are not suitable for the type of service ordered, where collection would be unsafe, or where the items fall under restricted or hazardous waste categories not covered by our standard services.

3. Booking Process

3.1 Customers may request services by telephone, email, online form, or by any other booking method made available by Rubbish Collection Belgravia from time to time.

3.2 At the time of booking, the Customer must provide accurate and complete information including, but not limited to, the collection address, access details, nature and approximate volume or weight of the Waste, any time constraints, and any relevant parking or loading requirements.

3.3 Any quotation given before the collection is an estimate only and is based on the information provided by the Customer. If, upon arrival, the Waste is materially different in type, volume, weight, or difficulty from that described at the time of booking, we reserve the right to revise the price, refuse the job in whole or in part, or offer an alternative service.

3.4 A booking is not confirmed until Rubbish Collection Belgravia has accepted the request, allocated a collection time or date, and, where applicable, received any required advance payment or deposit. We may, at our discretion, decline to accept any booking without providing a reason.

3.5 Any time or date indicated for the provision of Services is an estimate and is not guaranteed. While we will use reasonable efforts to meet agreed dates and times, delays may occur due to traffic, vehicle breakdown, adverse weather, or other circumstances beyond our reasonable control.

4. Customer Obligations

4.1 The Customer shall ensure that our operatives have safe, reasonable, and timely access to the collection point at the agreed time. This includes arranging necessary parking permissions or permits where required and providing accurate instructions to reach the premises.

4.2 The Customer must ensure that Waste is presented in a safe, accessible manner and is not contaminated with materials that may be hazardous, prohibited, or unsuitable for the arranged service.

4.3 The Customer shall be responsible for obtaining any permissions, approvals, or consents required for the collection, including from landlords, property managers, or neighbouring properties, where applicable.

4.4 The Customer confirms that they are the owner of the Waste or have the authority of the owner to arrange its collection and disposal. The Customer shall indemnify Rubbish Collection Belgravia against any claim arising from the removal of Waste where such authority has not been properly obtained.

5. Payments and Charges

5.1 Charges for Services will be communicated to the Customer at the time of booking or as soon as reasonably practical once the volume and type of Waste has been assessed. Prices may be based on factors such as the volume and weight of Waste, type of materials, access conditions, and any additional labour required.

5.2 Unless otherwise agreed, payment is due either in advance of the Service or upon completion of the collection, as notified by us. We may require full or partial payment at the time of booking to secure the appointment.

5.3 Payments may be made by accepted payment methods as notified by Rubbish Collection Belgravia, which may include card payment, bank transfer, or other approved methods. Cash payments may be accepted only where explicitly permitted and must be made directly to our authorised operative.

5.4 All prices are quoted in pounds sterling and may be subject to applicable taxes or government charges. Any such taxes shall be payable by the Customer in addition to the quoted price, where relevant.

5.5 In the event of non-payment, late payment, or chargeback, Rubbish Collection Belgravia reserves the right to charge reasonable administrative fees, interest on overdue amounts, and to recover any costs incurred in pursuing outstanding sums, including legal costs and debt recovery fees.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting Rubbish Collection Belgravia using the communication method originally used for the booking or by any other method specified by us.

6.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, any advance payment may be refunded or credited at our discretion, subject to any reasonable administrative charges.

6.3 If the Customer cancels a booking less than 24 hours before the scheduled collection time, fails to provide access at the agreed time, or is not present where their presence is required, Rubbish Collection Belgravia reserves the right to charge a cancellation fee or to retain any advance payment in full or in part to cover wasted time and operational costs.

6.4 Any requested changes to the date, time, or nature of the Services are subject to availability and may require an adjustment to the price. We are under no obligation to accommodate changes but will make reasonable efforts to do so.

6.5 Rubbish Collection Belgravia reserves the right to cancel or reschedule a booking at any time due to operational reasons, safety concerns, or circumstances beyond our control. Where we cancel a booking, any advance payment already made for that booking will be refunded or credited, and this shall be the full extent of our liability.

7. Waste Types and Regulations

7.1 Rubbish Collection Belgravia operates in accordance with applicable UK waste management legislation and regulations. All Waste collected will be transferred to appropriately licensed facilities where it will be processed, recycled, or disposed of in a lawful and responsible manner.

7.2 The Customer must not present hazardous or prohibited Waste for collection unless this has been explicitly agreed in advance and any additional charges have been accepted. Hazardous or prohibited items may include, but are not limited to, asbestos, chemicals, solvents, gas cylinders, clinical waste, certain electrical items, and any materials classified as dangerous or controlled substances.

7.3 If hazardous, prohibited, or unsafe items are discovered among the Waste, we may refuse to remove those items, apply surcharges, or in severe cases abort the collection entirely. Any additional costs incurred in safely handling or returning such items may be charged to the Customer.

7.4 The Customer is responsible for ensuring that Waste presented as part of a rubbish collection service is properly described and segregated if required. Misclassification or failure to disclose the true nature of Waste may result in additional charges or refusal of service.

8. Access, Parking, and Site Conditions

8.1 The Customer shall provide suitable access for vehicles and operatives to carry out the collection safely and efficiently. This may include ensuring driveways or access routes are clear, arranging parking permits, or providing loading space where necessary.

8.2 Any parking charges, penalty notices, or similar costs incurred by Rubbish Collection Belgravia as a direct result of inadequate information or arrangements by the Customer may be added to the Customer's invoice or charged separately.

8.3 The Customer must inform us of any specific site conditions, such as restricted access, height limits, long carrying distances, stairs, or fragile surfaces, before the booking is confirmed. Failure to do so may result in additional charges or refusal of service if the conditions make the collection unsafe or impractical.

9. Property and Site Protection

9.1 While our operatives will exercise reasonable care when working on the Customer's premises, the Customer is responsible for protecting floors, walls, fixtures, pathways, and any vulnerable surfaces prior to the collection.

9.2 Rubbish Collection Belgravia shall not be liable for minor scuffs, marks, or wear and tear reasonably associated with the handling and removal of heavy or bulky items, provided that our operatives have acted with reasonable care and skill.

10. Liability and Limitations

10.1 Rubbish Collection Belgravia will perform the Services with reasonable care and skill. If the Customer believes that any part of the Service has not been carried out with such care and skill, they must notify us within a reasonable time, providing clear details of the issue.

10.2 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

10.3 Subject to the above, Rubbish Collection Belgravia shall not be liable for any indirect, consequential, or special losses, including loss of profits, business interruption, or loss of opportunity, whether arising in contract, tort, or otherwise.

10.4 Our total liability for any loss or damage arising from or in connection with any single Contract shall be limited to the total amount paid or payable by the Customer for the Services under that Contract.

10.5 Rubbish Collection Belgravia shall not be liable for any delay or failure to perform the Services where such delay or failure is due to events beyond our reasonable control, including but not limited to severe weather, traffic disruption, accidents, acts of third parties, or regulatory actions.

11. Customer Complaints

11.1 If the Customer has any complaint regarding the Services, they should contact Rubbish Collection Belgravia as soon as reasonably possible, providing full details of the issue, the date of service, and any supporting information.

11.2 We will investigate complaints in good faith and seek to reach a fair resolution, which may include re-performing part of the Services, offering a partial refund, or another remedy as we consider appropriate in the circumstances.

12. Data and Privacy

12.1 Rubbish Collection Belgravia will collect and process certain personal data relating to Customers for the purposes of managing bookings, delivering Services, handling payments, and responding to queries or complaints.

12.2 By using our Services, the Customer consents to the processing of their personal data in accordance with applicable data protection laws. We will take reasonable steps to keep such data secure and will not share it with third parties except where necessary to provide the Services, process payments, or comply with legal obligations.

13. Variation of Terms

13.1 Rubbish Collection Belgravia may amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the revised Terms and Conditions have been issued or made available.

13.2 The version of the Terms and Conditions in force at the time of the Customer's booking will apply to that Contract, unless a change is required by law or regulatory authority, in which case the updated provisions may apply to existing Contracts.

14. Severability

14.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or any Contract for rubbish collection services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or confirmation issued by Rubbish Collection Belgravia, constitute the entire agreement between the Customer and Rubbish Collection Belgravia in relation to the provision of rubbish and waste collection services.

16.2 The Customer acknowledges that they have not relied on any statement, promise, or representation made or given by or on behalf of Rubbish Collection Belgravia that is not expressly set out in these Terms and Conditions.
